Important Notes

• Private Charter Basis: This booking is for a private boat charter for your exclusive group, up to the maximum capacity indicated for your chosen boat (e.g., 4, 8, or 12 persons). The price is for the entire boat charter, not per person.
• Maximum Capacity: Each boat has a strict maximum passenger capacity for safety and comfort (e.g., 4, 8, or 12 persons, including children). This capacity cannot be exceeded. Please ensure you select a boat charter suitable for your group size.
• Weather & Safety:
• The fishing trip is subject to weather and sea conditions. The Captain/Operator reserves the right to cancel or postpone the trip due to unsafe conditions. In such cases, options for rescheduling or a refund (as per our cancellation policy) will be offered.
• If the trip is curtailed after commencement due to unforeseen weather changes or safety concerns, any partial refund or compensation will be at the discretion of the Operator and subject to their terms.
• All passengers must adhere to safety instructions provided by the crew. Life jackets are provided and must be worn as instructed.
• Fishing Equipment & Bait: Standard fishing equipment and appropriate fish bait are provided for the charter. Specialized equipment requests may be accommodated at an additional charge and subject to availability; please inquire in advance.
• Catch Policy: Guests are welcome to keep their legal and appropriately sized catch, subject to local fishing regulations and the Captain's discretion regarding sustainable practices. The crew can assist with basic cleaning if time and conditions permit.
• Conservation Fees: Applicable Conservation Fees for Tunku Abdul Rahman Park are not included in the charter price. These fees are payable directly by guests upon arrival at the jetty or as instructed by park authorities. Please be prepared for this additional charge.
• Fishing Locations & Restrictions: Fishing will be conducted in designated areas, typically around Gaya Island. Fishing is strictly prohibited in protected marine park zones such as Manukan, Mamutik, Sapi, and Sulug Islands, unless in specifically permitted fishing zones. The Captain will navigate to approved and productive fishing spots.
• Liability: While all reasonable safety precautions are taken, guests participate in this activity at their own risk. SabahTravel.com and the boat operator are not liable for any loss, damage to personal belongings, injury, or unforeseen incidents during the charter. We recommend guests have adequate personal travel insurance.
• Inclusions: The charter includes the private boat, crew, fuel, standard fishing equipment, bait, ice, and beverages/lunch as specified in your chosen package details.
• Exclusions: Unless explicitly stated, the charter does not include items such as (but not limited to) Conservation Fees, specialized fishing gear, alcoholic beverages (unless specified), crew gratuities, or personal travel insurance.
• Conduct: The lead booker is responsible for the conduct of their group. Any damage to the boat or equipment caused by negligence may be chargeable. The Captain reserves the right to terminate the trip without refund if any passenger's behavior is deemed unsafe, disruptive, or illegal.
• Gratuities: Tipping the boat crew is not mandatory but is customary and greatly appreciated for excellent service.
• Booking Confirmation: Your charter is confirmed only upon full payment and receipt of a booking confirmation voucher from SabahTravel.com. Please present this voucher (digital or printed) on the day of your charter.
